Terms of Service for BirdexLast Updated: June 1, 2026Effective Date: June 1, 2026These Terms of Service ("Terms") govern your use of the Birdex mobile application and related services ("the App," "we," "our," or "us"). By downloading, accessing, or using Birdex, you agree to be bound by these Terms. If you do not agree, please do not use the App.1. About BirdexBirdex is a gamified birdwatching app available on iOS and Android that allows users to log sightings, collect bird cards, earn rewards, customise cards with cosmetics, connect with friends, compete on leaderboards, and track their progress. Birdex offers an optional paid subscription, Birdex Pro (see Section 9). Birdex is intended for personal, non-commercial use; the App remains fully usable for free without Birdex Pro.Birdex is operated by LAPWING LABS LTD, a company registered in England and Wales (company number: 17011251), registered office: Cornsclose, Aish Lane, South Brent, Devon, TQ10 9JF, trading as "Birdex".2. EligibilityYou must be at least 13 years old (or the minimum legal age in your country — in some EU/EEA countries this is up to 16) to use Birdex. By using the App, you confirm that you meet this age requirement. If you are under 18, you must have a parent or guardian's permission to use Birdex.3. Account RegistrationTo use Birdex, you must sign in using one of the following methods:- Apple Sign-In (iOS)
- Google Sign-In (Android)
- Email and password (available on both platforms)
You agree to provide accurate and current information when creating your account and to keep it up to date. You are responsible for all activity that occurs under your account. Do not share your login credentials or allow others to use your account.We may suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.4. User ContentWhen you log bird sightings, upload notes, add photos, or save locations, you retain ownership of your content. However, by submitting content within Birdex, you grant us a limited, non-exclusive, worldwide licence to store, display, and process that content solely to operate and improve the App.You represent and warrant that:- You own or have permission to upload any photos or content you submit
- Your content does not infringe any third party's rights (copyright, privacy, or otherwise)
- Your content does not contain unlawful, offensive, or harmful material
Your photos and sightings are private and are not shared with other users. Your bird sighting details, photos, location data, and notes are never visible to other users, even if they are on your friends list.5. Social FeaturesBirdex includes optional social features that allow you to:- Share your unique friend code with others so they can add you
- Send and receive friend requests
- View a limited summary of your friends' profiles (display name, avatar, level, species count, badges, sightings count, and photos count)
- Compare progress on a friends leaderboard
- View a global leaderboard ranking
Social features are entirely opt-in. You must actively choose to add friends using friend codes. You can remove friends at any time. Your detailed progress, bird sightings, photos, location data, and notes are never shared with friends or other users.6. Acceptable UseYou agree not to:- Use Birdex for commercial, illegal, or abusive purposes
- Upload false, misleading, or harmful information
- Attempt to gain unauthorised access to our servers or other users' data
- Copy, decompile, or reverse engineer the App or its content
- Exploit bugs, glitches, or vulnerabilities to gain unfair advantages in gameplay
- Use automated tools, scripts, or bots to interact with the App
- Interfere with the operation or security of Birdex
- Harass, abuse, or send unwanted friend requests to other users
We reserve the right to suspend or remove accounts violating these rules.7. Intellectual PropertyAll content within Birdex — including the app design, artwork, graphics, bird illustrations, sounds, layout, and code — is owned by Birdex or its licensors and protected by copyright, trademark, and other laws. You may not copy, distribute, modify, or create derivative works from Birdex content except as expressly permitted in writing. All bird illustrations, card designs, cosmetic assets, and UI elements are proprietary to Birdex and may not be reused outside the App without prior written consent.8. Rewards, XP, Virtual Items, and CosmeticsBirdex includes a progression system with XP, levels, badges, daily quests, daily quizzes, and an in-app virtual currency ("Golden Eggs"). These are virtual items with no monetary value and cannot be exchanged for real-world money, goods, or services.You may use Golden Eggs to purchase cosmetic items (such as card backgrounds and patterns) within the App. Cosmetic purchases are final and non-refundable, as Golden Eggs have no monetary value.Golden Eggs are an in-app virtual currency and are entirely separate from the paid Birdex Pro subscription described in Section 9. Golden Egg and cosmetic transactions are not real-money purchases and are governed by this section, not by the subscription terms in Section 9.We reserve the right to modify, reset, or remove XP, Golden Eggs, cosmetics, badges, or rewards in the event of data corruption, cheating, exploits, or system updates. We will endeavour to provide notice of significant changes where possible.9. Birdex Pro SubscriptionBirdex offers an optional auto-renewable subscription called "Birdex Pro" that unlocks premium features, including the Birdex map and Hub sightings map, the species and county heatmap overlays, the nature-reserves map, per-bird advanced statistics, and profile-wide advanced statistics. Birdex Pro is sold through Apple in-app purchase (iOS) and Google Play Billing (Android); your subscription is a contract between you and Birdex, processed by the relevant app store. The App remains fully usable for free without Birdex Pro.9.1 Products and PricesBirdex Pro is offered as two auto-renewable subscription products:- Birdex Pro Monthly — £5.99 per month
- Birdex Pro Annual — £49.99 per year
Prices are shown in your local currency at the point of purchase and may vary by region and by store. The exact price and subscription period are shown on the purchase screen before you confirm.9.2 Free TrialNew subscribers are eligible for a 3-day free trial of Birdex Pro. Free trials are available to new subscribers only and may be limited to one trial per Apple ID, Apple Family Sharing group, or Google account. At the end of the 3-day trial, your subscription automatically converts to a paid subscription and your account is charged the then-current price for the product you selected, unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited if you purchase a Birdex Pro subscription before the trial period ends. Eligibility for trials is determined by Apple or Google, not by Birdex.9.3 Automatic RenewalSubscription auto-renews unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your Apple ID settings. Any unused portion of a free trial is forfeited if you purchase Pro during the trial.On Android, manage or cancel your subscription in Google Play > Menu > Subscriptions.Your account will be charged for renewal within 24 hours before the end of the current billing period, at the price for the selected product, unless you cancel before that point. Your subscription renews automatically at the then-current price for the same period until you turn off auto-renewal.9.4 PaymentPayment for Birdex Pro is charged to your Apple ID account (iOS) or your Google Play account (Android) upon confirmation of purchase, and on each renewal. Billing, renewals, and payment methods for Birdex Pro are managed by Apple or Google, not by Birdex. Birdex does not collect, process, or store your card or payment-instrument details; all payment processing is handled by Apple or Google under their respective terms.9.5 Managing and Cancelling Your SubscriptionYou can manage your subscription and turn off auto-renewal at any time through your app store account. Turning off auto-renewal stops future charges but does not cancel the current subscription period; you keep Birdex Pro access until the end of the period you have already paid for, and the current period is not refundable except as required by law. Birdex cannot cancel a store subscription on your behalf or issue store credit. Deleting or uninstalling the app does NOT cancel your subscription.To cancel:- iOS: open Settings > [your name] > Subscriptions > Birdex > Cancel Subscription
- Android: open Google Play > tap your profile icon > Payments & subscriptions > Subscriptions > Birdex > Cancel subscription
9.6 RefundsBirdex Pro and any other in-app purchases are processed by Apple or Google, and all refund requests are handled by them under their respective refund policies and applicable law. Birdex cannot process or grant refunds for store-processed subscriptions. To request a refund, contact Apple Support or use reportaproblem.apple.com (iOS), or contact Google Play support (Android). Nothing in this section limits any non-waivable statutory rights you may have under the law of your country of residence (see Section 9.7).9.7 Your Statutory Cancellation Rights (UK/EU)If you are a consumer in the UK or EU, you normally have a 14-day right to cancel a purchase of digital content and receive a refund. Because Birdex Pro gives you immediate access to premium features, by purchasing and starting to use Birdex Pro you expressly request that supply begins immediately and you acknowledge that you will lose your 14-day right to cancel once supply has begun. This does not affect your other statutory rights, including your right to a remedy if the service is faulty or not as described. Refunds for store purchases are processed by Apple or Google as described above.9.8 Family SharingOn iOS, Birdex Pro supports Apple Family Sharing. If you enable Family Sharing for your purchases, eligible members of your Apple Family Group may receive Birdex Pro access on their own Birdex accounts. Family Sharing is provided and controlled by Apple under Apple's terms; Birdex does not manage which family members receive access. Family Sharing is not currently available for the Android (Google Play) version of Birdex Pro.9.9 Price ChangesWe may change Birdex Pro subscription prices. If we increase the price of your subscription, Apple or Google will notify you in advance and, where required by the relevant app store, will ask for your consent before the new price takes effect or will give you the opportunity to cancel. If you do not agree to a price increase, you can cancel before it takes effect; otherwise your subscription will renew at the new price.9.10 When Your Subscription EndsIf your Birdex Pro subscription expires, is cancelled, or is not renewed, your access to Pro features will end at the close of your current billing period and your account will revert to the free version of Birdex. Your account, bird sightings, photos, game progress, and other data are retained and are not affected; Pro features simply become locked again until you resubscribe.9.11 Store TermsYour purchase of Birdex Pro is also subject to the terms of the app store you bought it through — the Apple Media Services Terms and Conditions (iOS) or the Google Play Terms of Service (Android). Where those store terms govern billing, renewal, and refunds, they apply in addition to these Terms.10. Offline FunctionalityBirdex requires an active internet connection for most features. If you log a sighting while offline, it will be stored temporarily on your device and automatically synced to our servers when connectivity is restored. We are not responsible for data loss if offline sightings fail to sync due to app deletion, device issues, or other circumstances.11. Data and PrivacyYour data is handled according to our Privacy Policy, available at https://birdexprivacypolicy.carrd.co. By using Birdex, you acknowledge the collection and processing of your data as described in that Policy.We may process limited personal data (such as your Apple ID or Google account identifier, or — if you register with email — your email address and a securely hashed password, together with your display name, and, if you subscribe, your Birdex Pro subscription status and transaction metadata) for account authentication, gameplay, social features, subscription management, and diagnostics.12. Ownership of Uploaded PhotosYou retain all rights to your uploaded photos. You may share your own photos on social media or elsewhere. Your photos within Birdex are private and only visible to you. We do not use your photos for marketing, promotion, or any purpose other than displaying them within your personal sighting records.13. Giveaways and PromotionsBirdex may occasionally feature in-app giveaways or promotions. These may link to external websites or services. Participation in giveaways is voluntary. Separate terms and conditions may apply to specific giveaways and will be made available at the time of the promotion. We are not responsible for the content or practices of external websites linked from giveaways.14. TerminationWe may suspend or terminate your access to Birdex at any time, without notice, if you violate these Terms or if we reasonably believe your actions may harm the App, other users, or our systems.You may delete your account at any time from within the app — open your Profile (or Settings) and tap Delete Account — or by contacting us at the email below. Deleting your Birdex account does not cancel an active Birdex Pro subscription — you must cancel that separately in your Apple ID or Google Play account (see Section 9.5). Upon termination, your right to use the App ends immediately, and any data associated with your account may be deleted in accordance with our Privacy Policy.15. Disclaimer of WarrantiesBirdex is provided "as is" and "as available" without any warranties of any kind, except as required by applicable law. We do not guarantee that the App will be error-free, secure, uninterrupted, or compatible with all devices or operating system versions.Your use of Birdex is at your own risk. We are not responsible for loss of data, gameplay progress, or damage to your device resulting from use of the App, except to the extent caused by our negligence or to the extent such liability cannot be excluded under applicable law.16. Limitation of LiabilityTo the fullest extent permitted by law, Birdex, its developers, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, loss of virtual items, or interruption of service.In all cases, and to the fullest extent permitted by law, our total liability to you shall not exceed the total amount you paid to Birdex for the Birdex Pro subscription in the twelve (12) months immediately before the event giving rise to the claim. Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable law, including your non-excludable rights as a consumer under the Consumer Rights Act 2015.17. IndemnificationYou agree to indemnify and hold harmless Birdex and its team from any claims, damages, or expenses arising from your use of the App, your content, your interactions with other users through social features, or your violation of these Terms.18. Updates to the App and TermsWe may update Birdex periodically, adding, modifying, or removing features. We may also update these Terms. Updated Terms will be posted in the App with a new "Last Updated" date. Your continued use of Birdex after such updates means you accept the new Terms.If we make significant changes to these Terms, we will endeavour to notify you through the App.19. Governing LawThese Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes shal
